Former MSU athlete pleads guilty to rape

BOZEMAN - Former Montana State University basketball player Frank Brown pleaded guilty Monday to two counts of rape as part of an agreement possibly allowing him to avoid a prison term.

Brown's sentence depends on Fred Lemons, who has been hired by the state to do a psychosexual evaluation of Brown in the coming weeks to determine whether Brown can be treated in a "community setting."

If Lemons finds that Brown, 21, can be treated in a community atmosphere, the plea agreement will be honored and Brown would spend 30 days in jail, three years on probation, undergo treatment and register as a sexual offender.


If Lemons finds that Brown needs more than treatment in a community setting, the agreement is void and Brown would face trial.

Officers arrested Brown Nov. 23 and charged him with three counts of rape. One count was later dropped.

After his arrest, the former standout point guard for MSU was immediately suspended from the team. He posted a $20,000 bond, left school and has been living in Las Vegas with his parents.

Brown originally denied the charges but later acknowledged having sex with a 15-year-old girl on two separate occasions. Under Montana law, a 15-year-old can't consent to sex.

In court Monday, District Judge Mike Salvagni asked Brown, "How do you plead?" He responded, "Guilty, your honor."

His family sat in the front row of the courtroom. The victim sat a couple of rows behind them.

Salvagni told Brown that if Lemons finds he needs more than treatment in a community setting and the plea agreement is subsequently abandoned, Brown could face up to 100 years in prison and a $50,000 fine.

Brown's next court hearing was scheduled for Sept. 26.
