What happens if ...

Post by [cat_bracket] » Thu Jun 04, 2015 11:12 am

... Krakauer gets information from the commissioner of higher education that it, or um, screwed the pooch and Johnson should've remained expelled?

The new law or rule was in place, but um hadn't updated its policies. Are schools allowed lag time (in this case about 10 months) to update their policies? It doesn't appear so. The Dept. of Justice and Education rebuked um for using by the old standard and said the new dean of student affairs acquittal of Johnson didn't result in an equitable resolution of the complaint against him.

While there's nothing that the legal system can do, could there be something the NCAA can do? If um was negligent, could the NCAA penalize them?

I don't think that the NCAA wants to wade into Justice Department Title IX issues. I don't know what their motivation for doing so would be. It was a tough situation in Missoula, but I can definitely understand why UM didn't want to go through with expelling Johnson after the trial. After firing the coach and AD, I thought UM showed that they were being sufficiently serious about the issue.
