Not that I'm defending the NCAA
Sounds like his petition didn't get much past the secretary that opens the mail.
A problem with pushing decision making down to the lowest level is when the decision maker doesn't have a grasp of whether the rules as applied have the intended result.
All folks making decisions should have a good feel for the above and should not be hesitant about booting issues to the next level.
If this decision gets reviewed and doesn't change there are facts that have not been disclosed or NCAA is not serving its participants athletes
